Terms and Conditions
Please read these Terms and Conditions (“Terms”) carefully before using the MISO mobile application (the “App”). In these Terms, “MISO,” “we,” “our,” or “us” refers to the operator of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years of age to use MISO. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you must have permission from a parent or legal guardian. We reserve the right to restrict access for users who do not meet these requirements.
2. Description of Service
MISO is a food scanning and meal planning application that allows users to:
- Scan fridge and pantry contents using their device camera
- Receive personalised meal recommendations based on dietary goals
- Track food expiry to reduce waste
- Access additional features through a paid Pro subscription
MISO provides general food and meal guidance only. The App is not a substitute for professional dietary, medical, or nutritional advice. Always consult a qualified professional for specific dietary needs or health conditions.
3. No Account Required
MISO does not require you to create an account to use the App. You may access all core features without registering or providing any personal identifying information such as a name, email address, or password. Your onboarding preferences (such as dietary goals) are stored locally on your device.
4. Subscription Plans and Billing
4.1 Free Tier
MISO offers a free tier that includes a limited number of scans and access to basic meal recommendations. Features available on the free tier are subject to change at our discretion.
4.2 MISO Pro Subscription
MISO Pro is a paid subscription offering unlimited scans and access to all premium features. Subscriptions are billed on a recurring basis (weekly, monthly, or annually, depending on the plan selected) through Apple’s In-App Purchase system.
4.3 Billing and Renewal
- Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription at any time in your device’s App Store account settings.
4.4 Refunds
All purchases are processed by Apple. Refund requests are subject to Apple’s refund policies. MISO does not directly process refunds. To request a refund, visit Apple’s support at reportaproblem.apple.com.
4.5 Price Changes
We reserve the right to change subscription pricing at any time. We will provide reasonable notice of any price changes before they take effect. Your continued use of MISO Pro after a price change constitutes your acceptance of the new pricing.
5. Acceptable Use
You agree not to use the App to:
- Violate any applicable local, state, national, or international law or regulation
- Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to gain unauthorised access to any part of the App, its servers, or related systems
- Reverse engineer, decompile, or disassemble any part of the App
- Use automated tools (bots, scrapers, crawlers) to access or interact with the App
- Interfere with or disrupt the integrity or performance of the App or its data
- Use the App in any way that could damage, disable, or impair MISO’s servers or networks
6. Intellectual Property
6.1 Our Content
All content, features, and functionality within the App — including but not limited to text, graphics, logos, icons, images, the MISO name, and the App’s design — are owned by or licensed to MISO and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.
6.2 Your Content
When you use the App’s scanning feature, you grant MISO a limited, non-exclusive, royalty-free licence to process your camera images solely for the purpose of providing you with the App’s core functionality. This licence does not extend to any other use, including AI model training, without your explicit consent. You retain all ownership rights in any content you provide.
7. Camera Access and Image Processing
MISO requires camera access to function. By granting camera permissions, you acknowledge and agree that:
- Images captured during a scan are processed to identify food items
- Images are not permanently stored unless you save a scan
- You are responsible for ensuring you have the right to photograph any items or environments you scan
- You will not use the scanning feature to capture images of people without their consent
8. Disclaimers
8.1 No Nutritional or Medical Advice
MISO provides general meal suggestions based on the food items it identifies. This is not a substitute for professional dietary, nutritional, or medical advice. The App does not account for allergies, medical conditions, or individual nutritional requirements unless explicitly stated. Always consult a qualified professional before making significant dietary changes.
8.2 Accuracy of Scans
MISO’s food scanning technology uses AI image recognition, which may not be 100% accurate. Expiry dates, ingredient identification, and meal recommendations are estimates only. We do not warrant that any scan result is accurate, complete, or fit for any particular purpose. Always verify food safety independently.
8.3 “As Is” Service
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MISO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MISO IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless MISO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.
11. Termination
We may suspend or terminate your access to the App at our sole discretion, at any time and without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users, third parties, or MISO.
You may stop using the App at any time. Since MISO does not require account creation, there is no account to delete. Any locally stored data (such as dietary preferences) can be cleared by deleting the App from your device. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.
12. Third-Party Services
The App may contain links to or integrations with third-party services (including Apple’s App Store and payment systems). MISO is not responsible for the content, privacy practices, or terms of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date and notify you through the App or by email. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of [State — to be added], United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association’s Consumer Arbitration Rules, conducted in [City, State — to be added]. You waive your right to participate in a class action lawsuit or class-wide arbitration.
